MasterImage 3D Challenges RealD’s Utility Model Patent Application in Russia
Files Appeal Over Blatant Lack of Inventiveness; Committed to Rollout of HORIZON3D High-Brightness System
MasterImage 3D, a worldwide leader in
3D display technologies for digital cinema, challenged the validity of RealD’s
utility model (UM) patent in Russia by filing an appeal before the Chamber for
Patent Dispute. MasterImage 3D specifically
asserts that RealD’s utility model patent fails to meet the requirments for
patent protection in Russia.
RealD’s Russian utility model patent is
not valid and lacks novelty and inventiveness, according to MasterImage 3D. In facts, the UM application was only successfully
granted, because Russian UM patents lacks substantive examination.
RealD’s utility model patent
application was filed in response to MasterImage 3D’s new HORIZON3D product
line which uses a light recycling, triple-beam design to achieve
industry-leading brightness and accomodate contemporary auditoriums with wide
screens and immersive experiences. The
HORIZON3D is capable of 33% light efficiency and a throw-ratio as low as 0.8.
MasterImage 3D asserted that it will
stand with customers in all cases, as RealD has taken varying actions to
threaten customers around the world. If
RealD continues unsupported threats against MasterImage 3D customers,
MasterImage 3D will take any action necessary to stop them. MasterImage 3D is also evaluating their own legal remedies to counter RealD’s
misuse of the UM patent.
MasterImage 3D filed and has been
granted several invention patent applications in Korea for their innovative
technologies in 3D cinema systems. This
technology is the design for the HORIZON3D product-line. This inventive patent application has been
filed in Russia based on Patent Cooperation Treaty (PCT) procedures. RealD’s utility model in question was filed
after that of MasterImage 3D’s invention patent application.
